This site is for public use and information access. Copyright laws apply to all content. You're free to distribute this URL or link to this site without prior consent of our legal counsel.
If you are under the age of 18, you must not provide your name, e-mail address, or any other identifying information without the consent of your parent or guardian, or as otherwise provided for by applicable law.
In no event will Net Easy, Inc. be liable to any party for any direct, indirect, special or other consequential damages for any use of this web site, or on any other hyper-linked web site, including, without limitation, any lost profits, business interruption, loss of programs or other data on your information handling system or otherwise, even if we are expressly advised of the possibility of such damages.
General
Net Easy, Inc. general hosting policy is to act as a provider of Internet presence. Net Easy, Inc. reserves the right to suspend or cancel any customer's access to any or all services provided by Net Easy, Inc.
From time to time Net Easy, Inc. may impose reasonable rules and regulations regarding the use of its services. Such rules and regulations are called Acceptable Use Policies (AUPs) and are posted on the Internet at http://neteasyinc.com/aboutus/aup The AUPs are not exhaustive and Net Easy, Inc. reserves the right to modify the AUPs at any time, effective upon either the posting of the modified AUPs to http://neteasyinc.com/aboutus/aup or notification of the modified AUPs. By registering for and using the services, and thereby accepting the terms and conditions of the Master Services Agreement or its equivalent, you agree to abide by the AUPs as modified from time to time. Any violation of the AUPs may result in the suspension or termination of your account or such other action as Net Easy, Inc. deems appropriate. An unlisted activity may also be a violation of the AUPs if it is illegal, irresponsible, or disruptive use of the Internet. No credits will be issued for any interruption in service resulting from policy violations.
VIOLATION OF ANY AUP IS STRICTLY PROHIBITED AND MAY RESULT IN THE IMMEDIATE TERMINATION OR SUSPENSION OF THE SERVICES YOU RECEIVE FROM NET EASY. YOU SHALL REMAIN SOLELY LIABLE AND RESPONSIBLE FOR YOUR USE OF THE SERVICES AND ANY AND ALL CONTENT THAT YOU DISPLAY, UPLOAD, DOWNLOAD OR TRANSMIT THROUGH THE USE OF THE SERVICES. "CONTENT" INCLUDES, WITHOUT LIMITATION, YOUR E-MAIL, WEB PAGES, PERSONAL HOME PAGES, AND DOMAIN NAMES. IT IS NET EASY'S POLICY TO TERMINATE REPEAT INFRINGERS. NET EASY RESERVES THE RIGHT TO REFUSE SERVICE TO ANYONE AT ANY TIME
Outlines of Specific Acceptable Use Policies are to follow:
Server abuse
Any attempt to cause harm or undermine a server of Net Easy, Inc., or it's customers, is strictly prohibited and will not be tolerated. Resource Usage: No system has unlimited resources, and we expect you to act responsibly when consuming resources on the our system(s). If you consume unnecessary and excessive resources on our system we may suspend your access at any time without prior notice to correct the situation.
Unauthorized use of other people's accounts, computers & Password Protection
Any unauthorized use of accounts or computers by a Net Easy, Inc. customer, whether or not the attacked account or computer belongs to Net Easy, Inc., will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack. Net Easy, Inc. will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "Internet scamming" (tricking other people into releasing their passwords), password robbery and so on.
The customer is responsible for protecting the customer's password. The customer is responsible for any authorized or unauthorized use made of customer's password. The customer will not use or permit anyone to use Net Easy's service to guess passwords or to access other systems or networks without authorization. Net Easy will fully cooperate with law enforcement authorities in the detection and prosecution of illegal activity.
Customer Security Responsibilities
The customer is solely responsible for any breaches of security affecting servers under customer control. If a customer's server is involved in an attack on another server or system, it will be shut down and an immediate investigation will be launched to determine the cause/source of the attack. In such event, the customer is responsible for the cost to rectify any damage done to the customer's server and any other requirement affected by the security breach. The labor used to rectify any such damage is categorized as emergency security breach recovery and is currently charged at $250 US per hour. Inquiries regarding security matters are welcome.
Compromised Servers
A compromised server is one that has been accessed or manipulated by any third party not authorized by the customer. As a compromised server is potentially disruptive to the Net Easy network and to other customers, Net Easy can not allow a compromised server to remain online for extended periods of time. Therefore, once Net Easy has determined that a customer's server has been compromised and Net Easy has generated a support ticket to notify the customer of the compromised server, the customer will have 24 hours from the time Net Easy generates the support ticket to agree to one of the options offered by the Net Easy support team. If there has been no response at the end of the 24 hour period or if the customer responds but does not agree to one of the options offered by the Net Easy support team in the support ticket, the compromised server will be taken offline and all access to and use of such compromised server will be suspended. Customers will then have 5 days after the date of suspension of the compromised server to contact Net Easy to resolve the issue. If the issue is not resolved to the satisfaction of Net Easy after 5 days, the compromised server will be canceled and removed permanently from our network. However, the 24 hour grace period does not apply to any compromised server that is actively attacking other networks or other Net Easy customers. In these cases, Net Easy will act to protect the integrity of its network and will suspend or permanently terminate access to and use of such compromised server immediately without prior notice to customer.
System And Network Security
Violations of system or network security are prohibited, and may result in criminal and civil liability. Net Easy may investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. Examples of system or network security violations include, without limitation, the following:
- Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
- Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
- Interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks.
- Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting.
Violators of the policy are responsible, without limitations, for the cost of labor to clean up and correct any damage done to the operation of the network and business operations supported by the network, and to respond to complaints incurred by Net Easy. Such labor is categorized as emergency security breach recovery and is currently charged at $250 US per hour required. Enquiries regarding security matters are welcome. Net Easy is concerned with the privacy of online communications and web sites. In general, the Internet is neither more nor less secure than other means of communication, including mail, facsimile, and voice telephone service, all of which can be intercepted and otherwise compromised. As a matter of prudence, however, Net Easy urges its customers to assume that all of their online communications are insecure. Net Easy cannot take responsibility for the security of information transmitted over Net Easy's facilities.
Censorship
This does NOT apply if the information transmitted is illegal or is clearly used for fraud. Net Easy, Inc. has a policy of no-censorship, either from or to our systems. We welcome the freedom of speech and expression on the Internet. If ownership of content is contested on any site by a third party, Net Easy, Inc. will also request proof of copyright or ownership from both the alleging and accused parties. Net Easy, Inc. will NOT Host Adult sites and sites with adult content are not permitted in our programs. Net Easy, Inc. will NOT Host: illegal software sites, illegal copyright infringing MP3 sites and any nude photos. Any nude photos of individuals under the age of 18 will be reported to authorities along with all information regarding said client. All use logs shall be provided to authorities without client consent.
Child Pornography
Net Easy will cooperate fully with any criminal investigation into a Customer's violation of the Child Protection Act of 1984 concerning child pornography. Customers are ultimately responsible for the actions of their clients over the Net Easy network, and will be liable for illegal material posted by their clients.
According to the Child Protection Act, child pornography includes photographs, films, video or any other type of visual presentation that shows a person who is or is depicted as being under the age of eighteen years and is engaged in or is depicted as engaged in explicit sexual activity, or the dominant characteristic of which is the depiction, for a sexual purpose, of a sexual organ or the anal region of a person under the age of eighteen years or any written material or visual representation that advocates or counsels sexual activity with a person under the age of eighteen years. Violations of the Child Protection Act may be reported to the U.S. Customs Agency at 1-800-BEALERT
Internet Etiquette
The customer is expected to be familiar with and to practice good Internet etiquette (Netiquette). The customer will comply with the rules appropriate to any network to which Net Easy may provide access. The customer should not post, transmit, or permit Internet access to information the customer desires to keep confidential. The customer is not permitted to post any material that is illegal, libelous, tortuous, indecently depicts children or is likely to result in retaliation against Net Easy by offended users. Net Easy reserves the right to refuse or terminate service at any time for violation of this section. This includes advertising services or sites via IRC or USENET in clear violation of the policies of the IRC channel or USENET group.
Copyright Infringement - Software Piracy Policy
The Net Easy network may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, or by international law is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or other intellectual property rights.
Making unauthorized copies of software is a violation of the law, no matter how many copies you are making. If you copy, distribute or install the software in ways that the license does not allow, you are violating federal copyright law. If caught with pirated software, you or your company may be liable under both civil and criminal law, and you may be fined up to $250,000 and/or receive up to 5 years in jail.

Network Responsibility
Customers have a responsibility to use the Net Easy network responsibly. Customers are expressly prohibited from using the Net Easy network or services in such a way that adversely affects other Net Easy customers or the Net Easy network, and Net Easy reserves the right to suspend, block individual services, or cancel service with any customer who Net Easy determines in its sole discretion is in violation of such express prohibition. These prohibited uses include but are not limited to:
- Attacking or attempting to gain unauthorized access to servers and services that belong to Net Easy, its customers, or to any other entity on the Internet (i.e. computer hacking). Engaging in any behavior or activity or taking any actions that directly or indirectly result in any server under customer's control being the target of a Denial of Service (DoS) attack. Directly or indirectly using the Net Easy network, services or servers to launch DoS attacks.
- Participating in any other activity or behavior that results in reprisals that adversely affect the Net Easy network or other customers' access to the Net Easy network.
Customers that Net Easy determines in its sole discretion to be in violation of the Net Easy AUP, including, without limitation, the prohibitions set forth above, may be terminated and subject to additional fees or fines including, without limitation, any applicable reconnect fees. In addition, Net Easy reserves the right to take such other actions that Net Easy determines to be necessary to protect the Net Easy network and/or other Net Easy customers as a result of any violation of the Net Easy AUP, including, without limitation, the prohibitions set forth above.
Net Easy will react strongly to any use or attempted use of an
Internet account or computer without the owner's authorization. Such
attempts include, but are not limited to, "Internet Scanning" (tricking
other people into releasing their passwords), password robbery,
security hole scanning, port scanning, etc. Any unauthorized use of
accounts or computers by a Net Easy customer, whether or not the
attacked account or computer belongs to Net Easy, will result in severe
action taken against the attacker. Possible actions include warnings,
account suspension or cancellation, and civil or criminal legal action,
depending on the seriousness of the attack. Any attempt to undermine or
cause harm to a server or customer of Net Easy is strictly prohibited.
Violations of this policy may be reported directly to the FBI's
Infrastructure Protection & Computer Intrusion Squad. Net Easy
will cooperate fully with any civil and/or criminal litigation arising
from the violation of this policy.
System Users
Account Usage: Your account is for your exclusive and individual or company/organization use only. Multiple concurrent logins of the same account for multiple sites are not permitted to be freely given away or resold which would undermine our offerings of large space and traffic capacity. Your company or you become responsible for the charges incurred by someone else that you have allowed to use your account. For this reason you should protect your account and password as you would any other personal resource such as your Social Security or credit card number.
Abuse of Unmetered Traffic and Large Space
The Unmetered policy: Accounts deeming unmetered traffic are not pre-capped for traffic/hits, however do have a bandwidth allotment as explained in the plan description. Net Easy, Inc. does not specify how many visitors or hits are allowable to your account. This is what unmetered implies on our hosting plans. We expect you to be responsible and reasonable on our servers. The intention of Net Easy, Inc. is to provide a large space to serve web documents for your web site, NOT an offsite storage area for your electronic files, or a non restricted amount of resources to be given away or resold on any one single plan.
To maintain the integrity of our service the following common sense limitations apply: Sites running scripts from their domain used on other domains not hosted with Net Easy, Inc. thus pulling bandwidth (basically giving our bandwidth away to non customers). Sites offering extensive download files or archives (Email approval required). Any sites using more than 20% of system resources.
Any site after 30GB of monthly transfer (averaging 1000MB or more per day) will have to be recommended for a dedicated server, or a special hosting rate agreement with Net Easy, Inc. paying for additional bandwidth in advance. Additional bandwidth is $10 per GB. You will be notified before any charges are made or deducted from your card. Net Easy, Inc. will not charge or debit your credit cards for any overages without your consent. However if payment is not made, Net Easy, Inc. reserves the right to remove your account. Net Easy, Inc. will be the sole arbiter as to what constitutes a violation of this provision.
Commercial advertisements with e-mail
Unsolicited commercial advertisements are not allowed in e-mail, and will likely result in account suspension or cancellation. Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such. Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium.
Unsolicited Commercial Email/Unsolicited Bulk Email (UCE/UBE)
Net Easy, Inc. defines Unsolicited commercial email (UCE) as any electronic communication (e-mail, ICQ, IRC, Instant Messenger, pop-up ads via Windows Messenger Service, etc…) sent for purposes of distributing commercial information of any kind, soliciting the purchase or sale of products or services or soliciting any transfer of funds to a recipient who has not agreed to receive such communication.Net Easy, Inc. defines Unsolicited bulk e-mail (UBE) as any electronic communication (e-mail, ICQ, IRC, Instant Messenger, pop-up ads via Windows Messenger Service, etc…) to multiple recipients who have not agreed to receive such communication.
Use of the Net Easy network, servers or services to transmit any unsolicited commercial or unsolicited bulk-e-mail is expressly prohibited, as is hosting web sites or services on a server which are advertised in any UCE/UBE. Net Easy also prohibits the sending of any fraudulent, malicious, harassing, false or misleading electronic communications, including, without limitation, chain letters, pyramid schemes, or e-mails with forged headers. Posting off-topic advertisements to Usenet discussion groups, ICQ, Instant Messenger, etc., is also expressly prohibited. Additionally, Net Easy customers are expressly prohibited from sending any UCE/UBE from our network or any email from another network that in any way references a document, image, or Web site that resides on the Net Easy network or in one of our data centers. Violations of this type may result in the termination of the offending Net Easy account. Our customers are ultimately responsible for any violations of the AUP by their clients, and any violation of the AUP by a client of a Net Easy customer shall be deemed a violation of the AUP by such Net Easy customer.Customers whose actions directly or indirectly result in Net Easy IP space being listed in any of the various abuse databases may be subject to having the offending domain(s), server(s), or user(s) immediately removed from our network. In addition, if Net Easy in its sole discretion determines that a customer is in violation of our AUP, Net Easy may, at its sole discretion, restrict, suspend or terminate a customer's account. Net Easy will, in most cases, attempt to contact a customer prior to suspension or termination of a server(s), but can not guarantee prior notification. Any server suspended or terminated for AUP violations will be reconnected only after the customer agrees to cease all activities that violate the Net Easy AUP and pays all applicable reconnect fees and related charges. Any server suspended a second time for AUP violations WILL be immediately and permanently removed from our network.Customers that Net Easy determines in its sole discretion to be in violation of the Net Easy AUP may be subject to additional fees or fines including, without limitation, any applicable reconnect fees.Violation of Net Easy's UCE/UBE policy may be reported to http://neteasyinc.com/contact-info. Background Running Programs
We may allow programs to run continually in the background. These are considered on a one-by-one basis and must be cleared by Net Easy, Inc. before hand or the account may be terminated without notice.
IP Address Overlap
Net Easy administers the network on which customer servers reside. The customer cannot use IP addresses which were not assigned to them by Net Easy staff. Any server found using IPs which were not officially assigned will be suspended from network access until such time as the IP addresses overlap can be corrected.
Chat Rooms
We do not allow clients to install their own chat rooms without approving it with Net Easy, Inc.. Most chat rooms tend to be large system hogs and we cannot allow that. However, we do provide a choice of Java or CGI chat rooms FREE of extra charge in your control panel that should meet most needs without hindering the performance of the machine for others. Note: Hosted solutions available on the net that run on other servers that you simply embed or link to within your site do not apply to this rule. They are perfectly fine to install.
IRC
We currently do not allow IRC or IRC bots to be operated on our servers unless you have prior permission from a Net Easy, Inc. system administrator. If permission is granted, the use of IRC on a Net Easy server must not violate any of the other terms of this AUP. As a policy, Net Easy will not provide vanity IRC reverse DNS records. To enforce this policy Net Easy does not turn the reverse address of IPs over to the customer. Authority over this information remains with Net Easy.
Lawful Purpose
Net Easy, Inc. reserves the right to refuse service to anyone. Customers may only use Net Easy, Inc. services for lawful purpose. Transmission, storage, or presentation of any information, data or material in violation of any Federal, State or Local law, regulation or AUP is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. Net Easy, Inc. expressly forbids anyone from using our services for illegal purposes according to International, US and State law/regulation. Using any Net Easy service or product for the purpose of participating in any activity dealing with subject matters that are prohibited under applicable law is prohibited.Any conduct that constitutes harassment, fraud, stalking, abuse, or a violation of federal export restriction in connection with use of Net Easy services or products is prohibited. Using the Net Easy network to solicit the performance of any illegal activity is also prohibited, even if the activity itself is not performed. In addition, knowingly receiving or downloading a file that cannot be legally distributed, even without the act of distribution, is prohibited. The designation of any information, materials or data as such described above is left entirely to the discretion of Net Easy, Inc.
Servers hosted within Net Easy network are open to the public. You are solely responsible for your usage of the Net Easy network and servers and any statement you make on servers hosted within the Net Easy network may be deemed "publication" of the information entered. Acknowledging the foregoing, you specifically agree not to use our service in any manner that is illegal or libelous.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Net Easy, Inc. harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Net Easy, Inc., its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Net Easy, Inc. against liabilities arising out of;
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Net Easy, Inc.’s server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Net Easy, Inc. server.
Disclaimer
Net Easy, Inc. will not be responsible for any damages your business may suffer using our services. Net Easy, Inc. makes no warranties of any kind, expressed or implied for services we provide. Net Easy, Inc. disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Net Easy, Inc. and its employees. Net Easy, Inc. reserves the right to revise its policies at any time. All Sub-Networks, resellers and dedicated servers of Net Easy, Inc. must adhere to the above policies. Net Easy is under no duty to look at each customer's or user's activities to determine if a; violation of the AUPs has occurred, nor do we assume any responsibility through our AUPs to monitor or police Internet related activities. Net Easy disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person's or party's violation of this policy.
Suspension
If Net Easy in its sole discretion determines that a customer's server has become the source or target of any violation concerning the Net Easy Acceptable Use Policy (AUP), Net Easy reserves the right to suspend network access to that server. While Net Easy will attempt to contact the customer before suspending network access to the customer's server(s), prior notification to the customer is not assured. In certain cases, Net Easy will contact law enforcement and other agencies regarding these activities. Customers are responsible for all charges, as well as any fees relating to the investigation, suspension, administration and handling of their servers before, during and after the suspension period.
Payment Policies
All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts and major account changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. Net Easy, Inc. reserves the right to change prices at any time, unless other terms have been agreed upon or an account is prepaid. Any account not brought current within a week (7 days) of e-mail notice or exceeding this time frame in any way is subject to suspension. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Net Easy, Inc. in writing for a request for termination of services. All payments are in U.S. currency.
Cancellation
Net Easy, Inc. offers 3 easy methods of cancellation for your convenience, Mail, Fax or Verified Email. Due to security concerns, all account cancellations must be done in writing with the required information explained below:

Phone requests and unverified email without the above information will NOT constitute acceptance of any cancellation. Payment will be made by company check within 30 days of receipt of cancellation or by issuing credits to your credit card if any refunds are applicable after cancellation. Credit memos can be faxed to the account holder upon request after 30 days from cancellation date, if refunds were applicable, and documented proof of a credit/refund is required.
Net Easy, Inc. reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Net Easy, Inc. If Net Easy, Inc. institutes it's right of cancellation under any of our policies, fees are not waived refunded.
All of Net Easy, Inc.'s web hosting plans are backed by a 30 day money back guarantee. If you are not completely satisfied with our services or support within the first 30 days of your service, you will be given a full refund of the contract amount excluding setup fees, overages, long term agreements, or dedicated servers. Dedicated servers and Co-location is not covered due to cost incurred during setup. Dedicated server agreements are faxed and signed by you, and include their own guarantees. Setup fees are refundable only if the account ordered is canceled prior to activation. For web hosting accounts that are paid annually, Net Easy, Inc. will refund all unused months if a proper cancellation is submitted as noted above, and if you mention your prepaid status within that cancellation. This policy does not apply to any additional services such as overages, additional disk space, additional pop accounts, specialty hosting agreements, etc.
Billing
The customer understands that the customer is responsible for paying for any network resources that are used to connect the customer's server to the Internet. The customer may request that the customer's server be disconnected from the Internet, but the customer will still be responsible for paying for any network resources used up to the point of suspension or cancellation.
Assessment of Late, Overlimit Fee(s) and Returned Check Fee(s)
There is a $30.00 fee charged on all returned checks. Overdue accounts are subject to an interest charge of 3.5% per month along with a $25.00 late payment fee for per invoice. Due date is based upon type of service rendered and shall not exceed 30 days from completion of work. Due date appears on invoice.
Collection(s)
Your use of Net Easy services and/or signature(s) indicates that you agree that Net Easy, Inc., in its sole discretion, shall follow and enforce the following polices unless payment terms have been previously arranged / agreed.
On day 31 of delinquency, the account is assessed applicable late fee(s) and / or interest at Net Easy, Inc. sole discretion. Additionally, Net Easy, Inc., at its sole discretion, may file a complaint with various organizations like: Better Business Bureau(s), Hoovers, Dunn & Bradstreet, Credit Reporting Agencies, etc. regarding the delinquency issue.
Ongoing delinquency issue(s) are turned over to our collections service(s). Additionally, Net Easy, Inc. may notify credit bureaus of the delinquency issue and or seek legal actions.
You agree to pay all collections fees which shall include but not be limited to 100% attorney’s fees and court costs. You further agree to pay all court costs and any applicable and reasonable fees and charges permitted under Virginia, US and International Law.
Failure to follow any term or condition will be grounds for immediate account deactivation.
